The FDA & Big Pharma

The creation of the FDA was motivated by the noblest of intentions to protect the public health. But over time the FDA gradually became the promoter of the industry it was supposed to regulate, and its original mission of protecting the public was replaced with a desire to promote and protect the financial interests of the nation's most powerful corporations: drug companies.

This shift was due in part to the 1992 introduction of the Prescription Drug User Fee Act (PDUFA), which allowed the FDA to collect “user fees” from pharmaceutical companies in exchange for reviewing their drugs. This single Act, which was designed with the positive intention of speeding the approval of lifesaving drugs, ultimately had the opposite effect. It turned drug companies into the financial underwriters of the FDA, creating a customer relationship between the FDA and the big pharmaceutical companies.

By 1997, the FDA was poised to reauthorize direct-to-consumer (DTC) advertising, allowing drug companies to advertise via television, magazines, newspapers, and other mass media outlets. They spend billions of dollars marketing drugs to consumers and doctors, and this advertising is effectively unregulated allowing any claims, no matter how fraudulent, to be made in drug advertising.

The FDA does not require drug companies to submit ads for approval before being aired. Only the most egregious ads are scrutinized by the FDA. No other country in the world currently allows drug companies to advertise directly to consumers.   A study carried out by the Institute for Evidence-Based Medicine in Germany has found that 94 percent of the information contained in promotional literature sent to doctors by pharmaceutical companies has no basis in scientific fact. This means that 19 out of 20 statements made by drug companies in their marketing literature are are not true.
